Terms and Conditions of Supply

General 

This agreement applies as between you “Customers”, the User of this Website purchasing any goods and Pelican Supplies Ltd, the owner(s) of this Website, referred to as “we” or “us” or the “seller” or “Company” in these terms and conditions. By accessing this site and/or placing an order, you agree to be bound by these Terms and Conditions. Using this site indicates that you accept these Terms regardless of whether you choose to register with us or order from us. If you do not accept these Terms, do not us this site. Pelican Supplies Ltd “working days” refers to Monday to Friday excluding bank holidays and public holidays. 

We reserve the right to amend these Terms and Conditions at any time.  Current Terms and Conditions are displayed on our website and you are deemed to accept these current terms, unless you notify us in writing.

Accounts, Price, Payment & Quotation 

For credit account customers, payment shall be made in full within 30 days following the date of invoice. Pelican Supplies Ltd reserves the right to charge interest at 2.5% per month on overdue accounts. We reserve the right to withdraw credit facilities on all overdue accounts.  

To register with our website to place orders, you must be over eighteen years of age, each registration is single user only, and you are not permitted to share user accounts details and passwords with any other persons or multiple users. If you are an account customer, and wish to have multiple user accounts, you will make the request in writing to our company. 

Quotations shall only be valid for up to 30 days and available for acceptance for a maximum of 30 days from the date thereof and may be withdrawn by the Company within that period without notice. 

Prices quoted or shown are subject to change without prior notice and shall be those applicable at the date of supply unless otherwise specified by the Company in writing. Prices quoted or invoiced are not inclusive of VAT. All prices are subject to VAT at the rate current at the date of despatch. 

We must receive payment for the whole of the price of the goods you order, and any applicable charges for carriage and insurance before your order can be accepted and dispatched unless we have agreed otherwise in advance in writing for example, for our accounts customers subject to the previous clause.  

 

Descriptions, Illustrations, and pictures of any items  

All descriptions illustrations and pictures of any items and products on our website, in any catalogue, brochure, price list or in any other document provided by us are intended for general guidance only and do not form part of any contract between you and us.  

 

Deliveries and collection of goods 

We aim to request despatch of the Products from our suppliers within 24 hours of receiving your order, subject to the availability of the Product(s) in question. 

We offer free delivery on orders over £50 (ex. VAT) but this may be withdrawn at any time and may not apply where the Product(s) in your order are heavy, of an irregular shape or require a particular level of care on the part the carrier (e.g. furniture). All orders placed under the value of £50 (ex VAT) will be charged at our standard rate of £6.00 + VAT. Where an additional delivery charge is required, we will contact you to inform you and, subsequently, confirm the total delivery charge prior to order. 

We will deliver an order within the agreed period but our company does not accept liability for failure to deliver within the stated time where this is caused by circumstances beyond our reasonable control, such as delays caused by delivery companies or manufacturer lead times. If a delay is likely, we shall contact the Customer and advise of them delay but we cannot be held liable for any loss caused by late delivery. If we do deliver late you are not entitled to regard this as a breach of contract.  

Goods will be delivered to the delivery address supplied to us by you, you are required to be able to accept the goods when they are ready for delivery within Normal Working Hours. If we, or any agent on our behalf, cannot deliver to the delivery address then we may, either store the goods and deliver at a later date or return the goods to stock and deliver similar goods later. 

Delivery costs are displayed on our website and will be clearly shown during the checkout, and on any quotation provided by us. A valid signature may be required for goods on delivery or collection.  

 

Retention of Title 

All goods and materials supplied by us, remains our property until payments are received and cleared in full according to the terms and conditions.  

After delivery and until payment you must keep the goods fully insured. If the goods are lost, destroyed or damaged then you must hold the proceeds of the insurance for and to our order pending payment. If the goods are so destroyed you are not entitled to delay paying us until the insurer of the goods has paid you. 

We may enter your premises without notice and recover the goods, which have not been paid for in full. As between you and us, this sub-clause constitutes your authority for us to enter on the premises of any other person holding the goods on your behalf and on whose property the goods may be and remove the goods. 

 

Shortages, Damages, Discrepancies 

We will, at our discretion refund or replace where goods have been wrongly delivered or incorrect goods have been delivered as a result of our error, damaged in transit or there is a short supply of an order.  

We will only consider claims if made in writing to us within 2 working days of the date of delivery. If goods have been damaged or supplied short, then you must keep those goods in one place, separate from any other goods, and let us inspect them if we wish before we decide what action to take. If goods have been wrongly delivered as a result of our error or damaged in transit we will refund in full any shipping and handling charges and applicable tax charges. 

 

Returns Policy 

We are not obliged to accepts goods back for credit once they have been correctly despatched and supplied. Any returns will be agreed by us in advance.  

Unwanted items: please contact us within 14 days of arrival of items to notify us of a return request. The goods must be in their original manufacturer’s packaging and in re-saleable condition without any markings or damages, any items/goods returned and not fit for resale will not be credited. Any refunds/credits will be processed within 14 days of us receiving goods and inspected.  

The goods must be in their original manufacturer’s packaging and in re-saleable condition. In relation to hardware and software products the goods must be returned in re-saleable condition complete with all the accessories, manuals, cables etc. If we agreed for any returns, our company reserves the right to charge a minimum handling and administration charge of £5.00 or 20% of the value of the goods returned ‘not wanted’ or ‘incorrectly ordered’. All costs of returning goods shall be borne by the customer.  

For any faulty items or incorrect items, please contact us within 2 days we will advise you of the returns process. For any faulty items, you may need to contact the manufacturers directly but if you are unsure of the process, please contact us and we may be able to advise you. Any faulty items not covered by manufacturer warranty, we will arrange collection and dispatch replacement items or credit or refund but the items must be in their original manufacturer’s packaging and complete with all the accessories, manuals, cables, literatures etc.   

 

Force Majeure 

We reserve the right to cancel an order or suspend or delay delivery of it without being liable for any loss or damage if supply of the goods is prevented or delayed by reason of act of God, explosion, flood, tempest, fire or accident, war, threat of war, sabotage, insurrection, civil disturbance or requisition, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority; import or export regulations or restrictions; strikes, lock-outs or other industrial actions or trade disputes or any other causes or circumstances beyond our control. if we are unable to provide you with your Goods within a reasonable time due to circumstances outside our control, we shall either agree a new timescale with you for the delivery of the Goods or either of us may decide to terminate the order in which case we will return any prepayments that you have made in full. 

 

Governing Law and Jurisdiction  

These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
